These Terms and Conditions govern the provision and use of vehicle advertisements(Sell/Buy) on the AutoTout platform. Please read them carefully before placing an advert.

We may update these Conditions from time to time. It is your responsibility to review them regularly. Continued use of AutoTout constitutes acceptance of any updates.

1. DEFINITIONS

In these Conditions:

  • “AutoTout”, “we”, “us”, or “our” means AutoTout and its associated websites, mobile applications, and digital platforms.

  • “Platform” means the AutoTout website, mobile apps, APIs, and related services.

  • “Advertiser”, “you”, or “your” means any individual or entity placing an advert on AutoTout.

  • “Advert” means a vehicle listing created on the AutoTout platform.

2. SCOPE AND APPLICABILITY

These Conditions apply to:

  • All vehicle adverts placed, amended, renewed, or removed on AutoTout

  • All users globally, regardless of country or region

AutoTout is a global platform. Vehicle listings are displayed by country, and users will only see vehicle adverts relevant to their selected or detected country unless otherwise filtered.

3. OUR CONTRACT WITH YOU

By placing an advert on AutoTout, you enter into a legally binding agreement with us under these Conditions and any other policies referenced on the platform (including our Privacy Policy).

Each advert placed constitutes a separate contract between you and AutoTout.

3.1 Platform Role

AutoTout operates solely as an online marketplace that enables users to post vehicle adverts and communicate with one another.

AutoTout is not a buyer, seller, dealer, broker, agent, or intermediary in any transaction between users.

We do not participate in, control, or guarantee any transaction between buyers and sellers.

4. PLACING AN ADVERT

4.1 Account Registration

To place an advert, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities carried out under your account

We are not liable for losses resulting from unauthorized access caused by your failure to secure your account.

4.2 Accuracy of Information

You agree that all information you provide:

  • Is truthful, accurate, complete, and current

  • Does not misrepresent the vehicle or your identity

4.3 Free Listings

  • Listing a vehicle on AutoTout is free of charge for private individuals advertising vehicles for sale.

  • AutoTout does not currently charge listing, renewal, or removal fees for private adverts.

5. ADVERT PUBLICATION

  • We aim to publish adverts promptly but do not guarantee specific timelines.

  • Adverts may appear across AutoTout’s web, mobile, and partner distribution channels.

  • We reserve the right to review, approve, reject, edit, or remove adverts at our discretion.

6. ADVERT CONTENT GUIDELINES

Each advert must comply with the following rules:

6.1 General Rules

  • One advert per vehicle

  • One active advert per vehicle at any time

  • Content must be relevant to the vehicle being advertised

6.2 Prohibited Content

Adverts must NOT:

  • Contain false, misleading, or deceptive information

  • Infringe intellectual property or privacy rights

  • Include offensive, abusive, hateful, discriminatory, or illegal content

  • Contain spam, unrelated promotions, or external advertising

  • Impersonate another person or entity

  • Promote illegal activities or unsafe practices

6.3 Media Uploads

  • You are responsible for all uploaded photos and videos

  • Media must accurately represent the vehicle

  • We may remove media that does not meet quality or compliance standards

7. YOUR WARRANTIES

By placing an advert, you confirm that:

  • You have the legal right to sell the vehicle

  • The vehicle exists and is lawfully owned or authorized for sale

  • The advert is accurate and not misleading

  • You will not engage in fraud, deception, or unlawful conduct

  • You comply with all applicable local laws in your country

8. PRIVATE VS TRADE SELLERS

These Conditions apply primarily to private sellers.

If you are acting:

  • As a motor dealer

  • As a business

  • On behalf of another seller for commercial gain

You must not present yourself as a private seller.

We reserve the right to:

  • Reclassify or remove adverts we reasonably believe are trade adverts

  • Suspend or terminate accounts engaged in misrepresentation

9. OUR RIGHTS AND OBLIGATIONS

We will:

  • Operate the platform with reasonable care and skill

  • Use reasonable efforts to maintain availability and security

We do not guarantee:

  • Continuous, uninterrupted access

  • Successful sale of any vehicle

  • Buyer legitimacy or transaction completion

All interactions, communications, and transactions between users are conducted solely at their own risk. AutoTout is not responsible for any agreements, payments, disputes, or outcomes resulting from such interactions.

9.1 USER SAFETY

Users are solely responsible for their personal safety when interacting with others through the platform.

This includes meeting in person, inspecting vehicles, arranging test drives, and making or receiving payments.

AutoTout does not conduct background checks on users and is not responsible for the conduct, actions, or omissions of any user.

Users are advised to take appropriate precautions, including meeting in safe public locations and verifying all information independently.

10. TERMINATION AND REMOVAL

We may remove an advert or suspend an account at any time if:

  • These Conditions are breached

  • Content is unlawful, misleading, or harmful

  • Required by law or regulatory authorities

  • Fraud or abuse is suspected

You may remove your advert at any time via your account.

11. LIABILITY LIMITATION

To the fullest extent permitted by law:

  • AutoTout is not liable for losses arising from vehicle transactions

  • We are not a party to any sale or purchase agreement

  • We are not liable for anything

  • We do not verify buyer or seller identities beyond basic platform controls

Nothing limits liability for:

  • Fraud

  • Death or personal injury caused by negligence

  • Liability that cannot be excluded by law

AutoTout is not a party to any transaction between users and accepts no responsibility for the conduct of users or the outcome of any transaction.

12. INTELLECTUAL PROPERTY

By uploading content, you grant AutoTout a non-exclusive, worldwide, royalty-free license to use, display, distribute, and promote your advert and associated materials for platform operations and marketing.

You retain ownership of your content.

13. DATA PROTECTION AND PRIVACY

  • Your data will be processed in accordance with our Privacy Policy

  • Adverts are publicly accessible worldwide

  • You consent to the display of advert information globally

We may use anonymization, messaging masking, or security tools to protect user privacy.

14. GOVERNING LAW

Unless otherwise required by mandatory local law:

  • These Conditions are governed by the laws of Nigeria, England and Wales

  • Courts of Nigeria, England and Wales shall have non-exclusive jurisdiction

This does not affect your statutory consumer rights in your country of residence.

15. GENERAL TERMS

  • We may assign our rights and obligations

  • Invalid clauses do not affect the remainder

  • No waiver applies unless in writing

  • These Conditions form the entire agreement

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AutoTout, its affiliates, directors, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising from:

  • Your use of the platform

  • Your breach of these Conditions

  • Your adverts, listings, or content

  • Your interactions or transactions with other users
